These Terms of Service (the “Terms”) govern your use of vpnblocker.net, the VPN Blocker API, the dashboard and our other products and services (together, the “Service”). In these Terms, “VPN Blocker”, “administration”, “our”, “us” and “we” mean the operator of vpnblocker.net, and “you”, “your” and “user” mean the person or organization using the Service. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of an organization, you confirm that you are authorized to accept these Terms for it.
CHANGES TO THESE TERMS
We may update these Terms from time to time. When we do, we change the “Last updated” date above, and for significant changes we will make reasonable efforts to notify account holders by email. The updated Terms apply from the date they are published. If you do not agree with them, you must stop using the Service and cancel any subscriptions; continuing to use the Service means you accept the updated Terms.
ACCOUNTS AND API KEYS
You must provide accurate information when you create an account and keep it up to date. You are responsible for everything done with your account and API keys, including lookups made with a key that has leaked. Keep your API keys secret: use them from your own servers, never in code that runs in a visitor’s browser or app where others can read them. If you believe a key has been exposed, regenerate it from the dashboard or contact us straight away.
You may use an API key across your own websites, servers and applications. Each person or organization may hold one Free plan account; creating additional accounts to get more free lookups is not allowed.
PACKAGES AND PAYMENT
Prices are in US dollars. Packages, prices and features may change. Changes to the price of an existing subscription take effect from its next billing period, not part-way through a period you have already paid for. We accept card payments through our payment processor, Stripe. Your card details are collected and stored by Stripe, not by VPN Blocker. The Free plan requires a valid card on file when you sign up; the card is not charged for the Free plan.
Paid plans are subscriptions. Each subscription covers one API key and is billed monthly or yearly, at the start of each billing period, to your card on file. Subscriptions renew automatically at the end of each billing period until you cancel them. You can cancel a subscription at any time from your dashboard; the cancellation takes effect at the end of the current billing period, and the plan keeps working until then. It is your responsibility to manage and maintain any subscriptions you make to our service. If a renewal payment fails, the subscription may be suspended until payment succeeds.
Due to the nature of our digital service all sales are final, no refunds will be issued. A chargeback or card payment dispute will result in immediate termination of all services associated with your account.
Enterprise plans are provided under a separate agreement. Where that agreement conflicts with these Terms, the agreement applies.
FREE PLAN
The Free plan is provided as is and may be changed, limited or discontinued at any time. We may suspend Free plan keys that appear to be used to get around these Terms or the limits of the paid plans.
MONTHLY LIMITS
Each API key has a monthly lookup limit set by its plan. Usage resets at 00:00 UTC on the 1st of every month. Paid plans continue to work up to 110% of their monthly limit. Once a paid plan reaches 110% of its limit, or the Free plan reaches 100% of its limit, further requests are refused (HTTP 429) until the next monthly reset. Unused lookups do not carry over to the next month.
FAIR USE AND CACHING
You may cache API results in your own application for as long as suits it, and we recommend doing so to save lookups and avoid sending the same request repeatedly. Cached results remain subject to the Reselling, Sharing and Distributing and Prohibited Use sections.
Apart from the monthly limit of your plan, we do not enforce rate limits on our API service, but please send a reasonable amount of API queries per second. If your IP address is caught spamming or overloading our services or APIs it may be null routed. In the event your IP address is blocked and you would like it unblocked to continue using our services an administrative fee of $50 USD will be applied.
RESELLING
Our products and services may not be resold or re-hosted without explicit written permission from the VPN Blocker Administration.
SHARING AND DISTRIBUTING
Our products and services may not be shared or distributed online or in person to any individual(s), organization(s) or subsidiaries under any circumstances. This includes displaying the data supplied by our API service publicly for a given user input with the intent of undermining our operations. Any and all individual(s), organization(s) or each subsidiary of an organization that would like to make use of our product and/or service must purchase the appropriate license / API key where necessary.
PROHIBITED USE
Our products and services may only be used for lawful purposes. You may not:
- use the Service for data farming or data harvesting, including looking up large ranges of IP addresses to copy, rebuild or compete with our data;
- reverse engineer, scrape or try to get around the Service’s limits, keys or security;
- interfere with or disrupt the Service, or try to gain access to accounts, keys or systems that are not yours;
- use the Service to break any law, or to infringe the rights of others.
YOUR END USERS
When you send us the IP addresses of your own visitors or users, you are responsible for having a lawful basis to do so and for telling them, for example in your own privacy policy. Our Privacy Policy describes the data we record when you use the API. You are also responsible for the decisions you make using our results, such as blocking, challenging or allowing a user, and for making sure those decisions comply with the laws that apply to you.
ACCURACY OF RESULTS
Lookup results are based on automated analysis, including machine learning, and on third-party data, and IP addresses change hands over time. Results, categories and confidence scores are our best assessment and may be wrong. You should not rely on them as the only basis for a decision with serious consequences for a person. If you believe a result is wrong, you can report it from the dashboard; we look into reports but do not promise that a result will be changed or by when.
Geolocation fields (country, subdivision, city, postal code and location) include GeoLite2 data created by MaxMind and are approximate.
CHANGES TO THE SERVICE
We may change the Service, including the API, from time to time. We may add new response fields and new category values without notice, so your code should ignore fields and values it does not recognize. Where we plan to remove or change existing fields in a way that could break your integration, we will make reasonable efforts to give notice in advance.
SUPPORT AND AVAILABILITY
Support is provided by email through our contact page. We make reasonable efforts to keep the Service available, but we do not guarantee any particular uptime or response time unless agreed in writing, for example in an Enterprise agreement. The Service may be unavailable during maintenance or for reasons outside our control.
INTELLECTUAL PROPERTY
The Service, our website, our data and our documentation belong to VPN Blocker and its licensors. While you have an active account and follow these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service and the results it returns in your own websites, servers and applications. No other rights are granted.
SUSPENSION AND TERMINATION
You may stop using the Service at any time. To close your account, cancel any subscriptions and contact us. We may suspend or terminate your account or API keys, with or without notice, if you break these Terms, if your payment fails or is disputed, if your use puts the Service or other customers at risk, or if we are required to by law. When your account is terminated, your API keys stop working. Sections that by their nature should survive termination, including Prohibited Use, Intellectual Property, Indemnity, Disclaimer of Warranties and Limitation of Liability, continue to apply.
INDEMNITY
You agree to defend, indemnify and hold VPN Blocker, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any and all claims, damages, losses, obligations, liabilities, cost, debt or demands and expenses (including but not limited to attorneys’ fees), made by any third party due to or arising out of your content, your use of the Service, your end users’ activities, your connection to the Service, your violation of these Terms, or your violation of any rights of another, whether you are a registered user or not. You are solely responsible for your actions when using the Service, including, but not limited to, costs incurred for Internet access.
DISCLAIMER OF WARRANTIES
YOU EXPRESSLY UNDERSTAND AND AGREE THAT:
(a) YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. VPN BLOCKER EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
(b) VPN BLOCKER WILL MAKE REASONABLE EFFORTS TO MAINTAIN THE SERVICE, HOWEVER, VPN BLOCKER IS NOT RESPONSIBLE FOR ANY DAMAGE, LOSS OF DATA, CUSTOMER INFORMATION OR VENDOR DATA, REVENUE, OR OTHER HARM TO BUSINESS ARISING OUT OF DELAYS, MISDELIVERY OR NONDELIVERY OF INFORMATION, RESTRICTION OR LOSS OF ACCESS, BUGS OR OTHER ERRORS, UNAUTHORIZED USE DUE TO YOUR SHARING OF ACCESS TO THE SERVICE, OR OTHER INTERACTION WITH THE SERVICE. YOU ARE RESPONSIBLE FOR MAINTAINING AND BACKING-UP YOUR DATA AND INFORMATION THAT MAY RESIDE ON THE SERVICE. VPN BLOCKER DOES NOT WARRANT THAT (i) THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, AND (v) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.
(c) ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.
(d) NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
(e) WE EXPRESSLY DISCLAIM ANY LIABILITY FOR THE DATA AND CONTENT TRANSMITTED THROUGH OR TEMPORARILY OR PERMANENTLY STORED ON OUR NETWORK OR ANY SERVER AND FOR THE ACTIONS OR OMISSIONS OF USERS.
LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, VPN BLOCKER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, CUSTOMERS OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF WE HAVE BEEN TOLD SUCH DAMAGES ARE POSSIBLE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU IN FULL.
GENERAL
These Terms, together with our Privacy Policy and any Enterprise agreement, are the entire agreement between you and VPN Blocker about the Service. If any part of these Terms is found to be unenforceable, the rest remains in effect. If we do not enforce a part of these Terms, that is not a waiver of our right to enforce it later. You may not transfer your account or your rights under these Terms without our written permission. We are not responsible for delays or failures caused by events outside our reasonable control.
